This reminds me of a
story I saw in the
Rocky Mountain News today. A man terminally ill with lymphoma has to take lots of painkillers, including morphine, marijuana, and OxyContin. He has a license for the medical marijuana, but he was arrested for having an expired license--then the police wouldn't allow him to take his meds in jail. As a result, he suffered from seizures and immense pain. Now he's suing the City of Denver.
In that case, Ian, I do feel that the city was in the right. He had and expired license. If you drive on an expired license, you face severe charges. In all fairness it should apply here, too.
They did not allow him to bring his medication into prison because there are laws against possession of controlled substances in prisons. The prisons have horrible drug problems, so allowing someone to bring in drugs would be counterproductive to stopping those problems. My guess is that they were afraid that he would either sell his medications OR someone would extort them from him with threats of violence or offers of protection.
They did go overboard, yes, but I can see their logic.
