No, but I am a witness telling you what I saw. I still have photgraphic proof, so you can mince over the time all you want. I don't need to be a medical expert to tell you that I'm NOT sure when somebody died. Does your report say he died instantly? Huh? So there! I know he didn't, he even spoke to me!

Er... Gino was playing chess. 'He wasn't doing anything' is just a figure of speech. It means that 'he wasn't provoking the defendant in any way'. If that's what you need to know...
